Terms and Conditions for
[The Kubota Fund grant application website membership service – membership agreement]
Consent to the following membership agreement is required for registration.

(Purpose)
Article 1.
These Terms and Conditions (hereinafter referred to as "Terms") are provided for a person who wishes to apply for the selection of scholarship grant sponsored by the Kubota Fund, A Charitable Trust (hereinafter referred to as "the Fund") as a member specified in Article 2, Paragraph 1 of these Terms, and to determine the necessary membership registration method, usage conditions of information for registration, et al. (hereinafter referred to as "this service") on the internet website operated and managed by the Fund for applying for the scholarship grant (hereinafter referred to as "this site").

(Membership/Eligibility)
Article 2.
In these Terms, a member must (1) possess a valid passport issued by a country/region whose annual GDP per capita is less than seven thousand (7,000) US dollars (current price, estimated by International Monetary Fund at the time of registration); (2) be officially enrolled in an educational/research/training institute located in Japan during the time of grant payment; (3) stay in Japan for the duration of scholarship, except the period of field research abroad, attending international conferences, or temporarily returning to your home country.
2.  A person who wishes to register as a member of the preceding paragraph (hereinafter referred to as the "Applicant") shall apply by entering the prescribed items in the application form for joining the Service on the Site and sending it to the Fund.  Applicants are deemed to have confirmed and agreed to all of the contents of this agreement at the time of application.
3. If the Fund approves the application for membership registration in the preceding paragraph, the Fund shall send an e-mail confirming the membership registration to the e-mail address registered by the member.  At the time the Fund sends this notice, the Applicant shall be entitled to become a member of the Service.  The Fund may not approve the application if there is an adequate reason such as the applicant violates or is likely to violate these Terms.

(Member ID and password)
Article 3.
The Fund shall issue a member ID necessary for using this service to the member and notify it to the e-mail address registered by the member.
2. The member shall use the member ID specified in the preceding paragraph and the password registered by himself/herself to use this service.
3. The member shall use and manage the member ID and password specified in the preceding two paragraphs with the utmost care and shall not disclose them to third parties.
4. The Fund shall not be held responsible for any damages caused by errors in the use of member IDs and passwords by members and by third parties resulting from such errors.

(Use of Member Information by the Fund)
Article 4. The member shall consent to the use of the information provided by the member to the Fund (hereinafter referred to as "member information") for the purposes of the following items.
(1)    Relevant operations and management of the Fund
(2)    As a result of grantee screening, the member information of those who were selected as our managerial data after becoming grantees.
2. The member agrees that the Fund may outsource part of the work related to the provision of the Service to a third party (hereinafter referred to as the "contractor") and shall provide and disclose the member information to the contractor to the extent necessary for outsourcing the relevant work.
3. The Fund shall properly manage member information and shall not use it for any purpose other than the purpose of paragraph 1 without justifiable reason.
4. The member shall be able to change the member information by the method specified by the Fund.  However, due to such changes, the Fund shall not be liable for any damages such as being unable to receive information from the Fund.

(Use of Provided Information by Members) 
Article 5.
Members shall use all information provided by the Fund when using this service only for the purpose of their own application for the scholarship grant of the Fund.  In addition, the member shall not reproduce, modify or edit the information beyond the scope of personal use.
2. When using this service, the member shall appropriately manage the information provided by the Fund to the member.

(Withdrawal and Cancellation of Membership Registration)
Article 6.
Members shall be able to cancel their membership registration and withdraw from the service in accordance with the procedures specified by the Fund.
2. In the event that a member violates these Terms when using this service, or if the member commits any of the following acts, the Fund may immediately cancel the member registration without notifying the member in advance and the Fund shall be able to claim compensation for damages suffered by the act.
(1)    If you register as a member based on false information
(2)    When using this service for commercial purposes
(3) When using this service, if the information provided by the Fund is used for purposes other than those specified in Article 5
(4)    In the event of an act that interferes with the operation of this service or an act that may interfere with the operation of this service
(5)    In the event of infringing the property, reputation, privacy, or other personal rights of the Fund or a third party
(6)    In the event of infringing the copyright or other intellectual property rights of the Fund or a third party
(7)    Criminal acts, acts contrary to public order and morals, acts that violate other laws and regulations, or acts that are likely to do so.
3. If the Fund cancels member registration based on the preceding paragraph, the Fund shall not assume any responsibility to the member concerned.

(Resolution of Disputes and Responsibility of Compensation)
Article 7.
In the event that a member causes damage to another member or a third party, or a dispute arises due to acts such as violating this agreement when using this service, the member is responsible for compensation of the damage, process and resolution of the dispute at his/her expense, and also shall not cause any trouble to the Fund.

(Changes and/or Suspension of Service Contents)
Article 8.
The Fund shall be able to make changes to the contents of this service without prior notice to members.  In this case, the Fund shall notify the content of such changes on this site as necessary.
2. The Fund may suspend the service when a natural disaster or other emergency occurs or is likely to occur, or for other inevitable reasons.  In the case, the Fund shall give prior notice on the site, except in cases of emergency.

(Changes to These Terms)
Article 9.
The Fund reserves the right to change these Terms when the change conforms to the general interests of members or when it is otherwise reasonable.
2. In the case of the preceding paragraph, before the change, the Fund will announce the changed Terms on this site after setting the date of change in advance.

(Period of Provision of This Service, et al.)
Article 10.
The period of provision of this service shall be from 02 December 2024 to 31 March 2025 (planned).  In addition, upon expiration of the period, the member shall be deemed to have withdrawn from this service without the need for withdrawal procedures.
2. Members shall be able to receive the provision of this service free of charge.  However, the member shall be responsible for the costs such as communication line charges necessary for using this service.

(Priority Application)
Article 11.
If there are provisions on this site that differ from these Terms, or if there are provisions that are not stated in these Terms, those provisions shall apply with priority.

(Jurisdiction)
Article 12.
The Tokyo District Court shall be the exclusive jurisdictional court of first instance for all disputes relating to this agreement and the use of this service.

(Governing Law)
Article 13.
Japanese law shall apply to the formation, effectiveness, performance and interpretation of this agreement.

(Organization Responsible for Personal Information Management)
Article 14.
Personal information provided by members of the Fund shall be managed responsibly by the following organization.

<Supplementary Provision>
This Agreement shall be enforced from 02 December 2024
